Actually, private ownership of nuclear weapons is covered under the power of Congress to issue Letters of Marque and Reprisal (arguably no CREW operated or maintained weapon falls under the INDIVIDUAL right protected by the Second Amendment). I sometimes amuse myself with the idea that Congress might someday issue Letters of Marque and Reprisal for $1,000 apiece, with the understanding that while a warhead is transferred to the letter holder for an hour the holder may not actually try to trespass on Federal land to collect it. Nice collector's item there! I'd bet Letters dated the 4th of July, Veterans Day, and Memorial Day would be most popular.

We must also remember that the power to pardon by our President comes down from the power of a King to pardon. But, as Blackstone noted in his commentaries on the common law that predate our founding documents: "The king's charter of pardon must be specially pleaded, and that at a proper time: for if a man is indicted, and has a pardon in his pocket, and afterwards puts himself upon his trial by pleading the general issue, he has waived the benefit of such pardon. But, if a man avails himself thereof as soon as by course of law he may, a pardon may either be pleaded upon arraignment, or in arrest of judgment, or in the present stage of proceedings, in bar of execution." The notion of a "blanket pardon" is an abomination. Only a fool would argue for such a result.
